Misconduct in the Philadelphia Police Department

The history of the Philadelphia Police Department (PPD) includes numerous accusations of police misconduct by its officers. Some of the cases have been proven in a criminal court, while others were merely allegations.

1974

The 1974 Pennsylvania Crime Commission's "Report On Police Corruption And The Quality Of Law Enforcement In Philadelphia" concluded "The commission found that police corruption in Philadelphia is ongoing, widespread, systematic, and occurring at all levels of the police department. Corrupt practices were uncovered during the investigation in every police district and involved police officers ranging in rank from policeman to inspector. Specific acts of corruption involving improper cash payments to the police by gamblers, racketeers, bar owners, businessmen, nightclub owners, after-hours club owners, prostitutes, and others are detailed in the report. More than 400 individual police officers are identified by first name, last initial, and badge or payroll number as receiving improper payments in terms of cash, merchandise, sexual services, or meals." [1]

1981

In 1981, PPD officers framed Neil Ferber for the murders of mobster Chelsais Bouras and his companion, Jeanette Curro. In January 1986, Ferber was vindicated and released after serving three and a half years in prison. In 1993, a civil jury found that Sgt. Daniel Rosenstein and Officer Dominic Frontino had conspired to frame Ferber, awarding him a $4.5 million judgement, an amount thrown out by the civil trial judge in 1994 due to changes to the state's liability laws. In 1996, Ferber received $1.9 million to settle his lawsuit against the police. Neither Rosenstein nor Frontino were ever disciplined in any way, but Rosenstein was promoted to captain. The murders remain unsolved. Ferber died of a heart attack in December 2008.[2][3]

1984

On August 10, 1984, seven PPD officers were convicted of corruption charges, including Deputy Commissioner James J. Martin; Chief Inspector Joseph DePeri; Captain Dennis Linso; Lieutenants Theodore Murphy, Henry Pecic, and George Katz; and Officer George Morrell.[4] In October 1984, Martin was sentenced to 18 years in prison. Martin had been the second highest ranking Philadelphia cop, behind only the commissioner. Martin died in January 1986, before serving any of his sentence.[5] On August 19, 1986, DePeri's 15-year federal prison sentence for a corruption conviction was upheld by a district court judge.[6]

1986

On March 3, 1986, Chief Inspector Eugene J. Sullivan, III was sentenced to 13 years in federal prison for his extortion-related conviction.[7]

On October 14, 1986, six current and three former PPD officers were arrested on corruption charges, with the former six also being fired and the latter three having been fired several months earlier. Eighteen civilians were also arrested on related extortion and bribery charges. The recent federal probe had thus far resulted in the convictions of 31 PPD officers.[8][9][10] Sergeants Andrew Kalmar and Patrick Devlin went undercover in a Frank Serpico-like manner, risking their lives in order to gather evidence against the rogue cops and their civilian counterparts.[11][12][13]

1987

On July 29, 1987, Captain Edward Spangler and Officer Anthony Mairone were sentenced to respective seven and four year federal prison terms for extortion-related convictions.[14][15][16]

1988

On May 27, 1988, Cpl. Howard Levitt committed suicide. Levitt doused a police vehicle with gasoline in front of his headquarters on Academy Road near Red Lion and shot himself in the head. Other officers pulled his body from the vehicle moments before it exploded in flames. [17]

On August 8, 1988, Officer Denise Stewart committed suicide. Stewart was the second city cop to kill herself on police property in three months.[17]

1995

In the early 1990s, the 39th District corruption scandal led to the 1995 convictions of six officers.[18][19] The six white officers were ultimately convicted of robbing, beating, and framing more than 40 black people.[20]

In 1995, Officer John Baird was convicted in federal court of robbing, assaulting, and framing black people. He was originally sentenced to 13 years in prison, but was subsequently re-sentenced to four-and-a-half years.[21] Baird suggested that thousands of other Philadelphia police officers have engaged in similar racist brutality and corruption.[22]

On April 7, 1995, PPD officers Derrick Mayes and Kevin Daniels were convicted of charges related to robbing, planting drugs on, and falsely arresting young men in West Philadelphia. Each officer was sentenced to five to 10 years in prison.[23]

On June 8, 1995, Sgt. Gene Lomazoff was convicted of robbing motorists. He was sentenced to seven to 22 years in prison.[23]

1998

On January 13, 1998, Officer Michael Stieber was sentenced to prison for robbing a motorist of $10,000.[24]

In 1998, the PPD found that Lt. Joseph DiLacqua had tried to cover up a drunk driving accident caused by a fellow officer and then lied about it. The PPD had previously found that DiLacqua had also tried to conceal a fatal drunk driving crash allegedly perpetrated by a stripper, crashed his own police car but falsely reported that it was struck while parked, called Latino cops "conquistadors", lied in a report about a police raid, tried to cover up yet another drunk driving (and drug possession) incident, and perpetrated two other violations. DiLacqua was suspended for six of the violations and reprimanded for the other two. Nonetheless, he was promoted to captain in 2001.[25][26]

2003

In October 2003, PPD officer Robert O'Brien was fired for a September 2001 incident during which he pointed a gun at a 16-year-old Police Explorer. O'Brien was convicted of endangering the welfare of a child and reckless endangerment.[27]

In 2003, ex-PPD officer Walter Helinsky was sentenced to prison for having sex with a 13-year-old girl, reportedly over 100 times, on certain instances while on police duty.[28][29][30]

2004

In December 2004, a U.S. Department of Justice-funded study about PPD officer misconduct was released. The study attempted to establish guidelines for predicting police wrongdoing and analyzed certain aspects of police sociology and psychology. The study was critical of the lax manner in which the PPD dealt with its officers' corruption and brutality.[31]

2006

On January 17, 2006, PPD officer David Bickel shot James Lynch eight times, wrongfully according to the $220,000 judgement awarded to Lynch by a civil jury.[32]

On November 7, 2006, a federal jury ordered two ex-PPD officers, James Fallon and Timothy Carre, to pay $8.3 million to a stripper whom the two had (on November 14, 2003) pleaded guilty to sexually assaulting while on duty in December 2002. The stripper was one of nine women who had filed sex abuse-related complaints against the two officers.[33][34][35][36][37]

2007

In 2007, PPD officer Drexel Reid, Jr. was arrested for his involvement in a car insurance fraud ring that involved over 95 people, including at least one other PPD police officer. Reid later pleaded guilty.[38]

On November 15, 2007, PPD officer Colleen Brubaker was sentenced to prison for stealing drugs that had been confiscated in 33 cases.[39]

2008

In 2008, PPD officer Deshane Riggins pleaded guilty to his role in a car insurance fraud ring involving over 95 people, which included Riggins filing bogus traffic accident reports to support fake insurance claims.[40]

On November 17, 2008, PPD sergeant Chauncey Ellison shot an unarmed 19-year-old, Lawrence Allen, in the back when Allen tried to resolve a dispute between Ellison and another man involving a pizza. Allen died a year later as a result of his injuries. Four years after the shooting, Ellison and PPD officer Robin Fortune were charged with multiple counts in the killing, but both officers were convicted of only one of the charges, reckless endangerment.[41][42][43][44] Allen's estate received $650,000 to settle its lawsuit against the officers and the city.[45][46]

2009

In 2009, PPD officer Frank Tepper shot and killed a neighbor, 21-year-old William Panas, Jr., in an incident not related to the police department - although Tepper later claimed that he had identified himself as a police officer to Panas prior to shooting him. In 2011, Tepper was found guilty of first-degree murder and subsequently sentenced to life in prison without the possibility of parole.[47][48] Tepper is the recipient of at least 35 prior formal and informal citizen complaints, many of which involved allegations of assault.[49][50][51]

In March 2009, PPD officers allegedly assaulted Jewell Williams, who won a $50,000 judgement from a lawsuit against the officers in December 2011.[52][53]

On March 27, 2009, PPD officer Alhinde Weems was arrested on drug charges.[54] Weems was subsequently convicted and on July 23, 2010, Weems was sentenced to 15 years in federal prison.[55]

In April, 2009, PPD sergeant John Safarowicz was charged with burglary, criminal trespass, and related offenses.[56] Safarowicz was convicted on June 4, 2010.[57]

On June 16, 2009, PPD detective Rickie Durham was charged with obstruction of justice, giving advanced notice of a search, and making false statements to federal law enforcement officers.[58] Durham was subsequently convicted and sentenced to two years in prison.[59]

On October 16, 2009, PPD officer Malaika T. Mebane was arrested on charges of attempted sexual assault and related offenses.[60] Mebane was subsequently convicted and on November 12, 2010 was sentenced to two to four years in state prison.[61]

On October 24, 2009, PPD officer John King was arrested for pointing his gun at a hospital security guard. On February 9, 2012, King pled guilty to assault.[62][63]

On November 10, 2009, PPD officer Malik Snell was sentenced to 30 years in federal prison for his role in a violent attempted robbery.[64][65]

In 2009, an association of black police officers filed a federal lawsuit against the PPD stating that white police officers posted racist comments to the website domelights.com. The suit, joined by the NAACP and the National Association of Black Law Enforcement Officers, seeks to have the site domelights.com shut down and the police department discipline its users.[66][67] As of January 12, 2012, the litigation against the department was still active.[68]

2010

In April 2010, Officer Robert Ralston, a 21-year veteran of the PPD, shot himself in the shoulder and claimed that he had been shot by one of two African Americans who he claimed had fled the scene.[69] His statements resulted in a massive manhunt including SWAT personnel. After being confronted with evidence showing that he had shot himself and being offered immunity, he confirmed that the wound was self-inflicted. As of June 2010, Ralston had been fired after being placed on paid leave following the admission.[70]

On May 17, 2010, a video was uploaded on YouTube that shows a white police officer punching a restrained, handcuffed black man in the face. The video has since gone viral, amassing over 141,000 views as of July 23, 2014.[71] On May 18, 2010, the same video was uploaded by World Star Hiphop, and has garnered over 159,000 views as of July 23, 2014.[72]

On July 13, 2010, Officers Mark Williams, Robert Snyder, and James Venziale were indicted for conspiracy and related offenses involving heroin.[73] The three officers were convicted and received respective prison terms of 16 years, 13 years, and 42 months.[74][75][76]

On July 18, 2010, Officer Damien Walto allegedly assaulted a woman, for which was arrested on August 20.[77][78] On March 30, 2012, a jury convicted Walto of assault.[79] On June 14, 2012, Walto was sentenced to prison.[80]

On July 30, 2010, Officer Adrian Makuch was sentenced to prison for soliciting sex from minors.[81]

2011

On January 5, 2011, Officer Aleksander Shwarz was arrested for the March 4, 2010 false arrest of U-Haul manager Dominic Catalano in his store's parking lot. The incident was captured on video. Shwarz was charged with official oppression, filing a false police report, false imprisonment, obstruction of justice, unsworn falsification to authorities, assault, and unlawful restraint.[82] Shwarz was subsequently convicted of some of the charges and sentenced to one to two years in prison on June 7, 2012.[83] In 2007, Shwarz fatally shot 15-year-old Ronald Timbers inside his own home. Timbers was unarmed and not threatening anyone when he was shot, according to his mother, Yvonne Young. Young sued Shwarz and the city over the shooting in federal court, settling out of court.[84][85] In 1992, Shwarz shot and seriously wounded his unarmed cousin, Alexander Vetenshtein, during an argument. Vetenshtein sued Shwarz and the city over the shooting, settling out of court.[86][87]

On January 31, 2011, the Philadelphia Daily News published the results of their investigation of the internal affairs complaint filing process, revealing that filing such complaints against PPD officers is often hindered by the refusal of police supervisors to follow their own department's rules and regulations.[88]

In February 2011, the FBI said it was investigating "widespread corruption" within the Philadelphia Police Department.[89]

In March, 2011, Sgt. Dwayne Darby, II was fired and charged with attempted theft by deception and perjury.[90] On February 7, 2012, Darby pleaded guilty.[91]

In April, 2011, Officer Joseph McIntyre was indicted for conspiring to distribute illegal drugs.[92] McIntyre was convicted and sentenced to prison.[93]

On April 22, 2011, Officer Drexel Reid was sentenced to 30 months in federal prison for his role in a fraud conspiracy.[94]

In June 2011, Officers Sean Alivera and Christopher Luciano were each sentenced to 10 to 15 years in prison for robbery and related offenses.[95]

On June 30, 2011, Officer Matthew Sharkey pled guilty to a DUI crash that nearly killed a Pennsylvania state trooper. Sharkey was subsequently sentenced to three years in prison.[96][97]

In October 2011, Officer Kenneth Crockett was convicted of stealing $825 from an open safe in a bar. Crockett lost his job and pension and was sentenced to probation.[98][99]

In October, 2011, Officer Charles Jacoby was indicted by federal authorities for fraud. Jacoby was convicted and sentenced to house arrest.[100]

2012

In the fiscal year ending in 2012, the city paid out at least $12 million to settle police misconduct lawsuits, such as those alleging unjustified shootings, excessive force, and false arrest.[101]

On February 9, 2012, Officer Kevin Workman pled guilty to stealing cash.[102]

In March 2012, Officer Keith Corley was found guilty of indecent exposure and official oppression for an incident with a woman in his squad car. Corley was acquitted of rape, sexual assault, and two related charges.[103] On June 28, 2012, Corley was sentenced to prison plus reporting probation. Corley was one of 43 Philadelphia police officers charged with crimes in the prior three years.[104]

On May 3, 2012, Officer Anthony Dattilo was arrested for allegedly sexually assaulting a 14-year-old girl.[105] Dattilo pleaded guilty on June 17, 2013.[106] He was sentenced to up to 20 years in prison in December 2013.[107]

On December 12, 2012, Officer Robertito Fontan was fired (via a 30-day suspension process) and formally indicted for making false statements to federal investigators.[108] Fontan was convicted and sentenced to a year in prison.[109]

2013

On January 7, 2013, Detective Keith Gidelson was sentenced to four years in federal prison for operating an illegal drug ring.[110][111]

On March 15, 2013, Inspector Daniel Castro was re-sentenced to five years in prison on an earlier extortion-related conviction.[112] Castro was originally sentenced to five years on October 4, 2011 after pleading guilty.[113] Castro was first arrested on November 5, 2010.[114] Additional charges against Castro were filed on February 4, 2011.[115]

On March 19, 2013, the American Civil Liberties Union filed a report in federal court claiming the police are not adhering to the consent decree in Bailey v. Philadelphia, which requires officers to stop targeting black men for stop-and-frisk at a disproportionate rate.[116]

In May 2013, Officer Jonathan Lazarde was charged with bribery and extortion.[117] He was subsequently convicted and sentenced to house arrest.[118]

On May 22, 2013, Officer Jeffrey Walker, a 24-year veteran was arrested for ripping off drug dealers. He was allegedly caught on audio tape and on surveillance video talking to an FBI informant about schemes to set up known drug dealers in order to steal their drugs and cash. He was taken into custody leaving a home of an alleged drug dealer.[119] In October, seventy drug convictions, thought possibly tainted by Walker were dropped.[120] On February 24, 2014, Walker pleaded guilty to attempted robbery that interferes with interstate commerce and carrying a firearm during and in relation to a crime of violence. Walker faces up to 10 years imprisonment under federal sentencing guidelines.[121]

On December 3, 2013, Officer Rafael Cordero, who had served the department for 23 years, was convicted of providing sensitive police information to a local drug gang.[122] On June 25, 2014, Cordero was sentenced to 15 years in federal prison.[123]

In the fiscal year ending in 2013, the city paid out $16 million to settle police misconduct lawsuits.[101]

2014

In 2014, the Philadelphia Daily News revealed that in a recent six year period, the city had paid over $70 million to settle lawsuits filed against its police officers.[124] On October 21, 2014, the Daily News also disclosed that from 2009 to date, the city had paid more that $40 million to settle 584 of the 1,223 misconduct lawsuits filed against its officers.[125]

On February 28, 2014, PPD officer Paul Zenak won a lawsuit which stated that his police supervisors had retaliated against him for being a whistleblower. A jury awarded Zenak back his old assignment plus a monetary judgement to be determined later by the trial judge.[126][127]

On July 31, 2014, the Committee of Seventy, a nonpartisan watchdog group, called for the establishment of a powerful police oversight body. The Committee's president, Ellen Kaplan, proclaimed that "Police misconduct has become an epidemic. Too many officers play by their own rules and are poisoning the integrity of the entire police force...It has crushed the confidence of the citizens of Philadelphia.". Philadelphia is the lone city of the country's 20 most populous that does not have an independent review board that has the actual authority to fire and otherwise discipline its cops.[128]

On August 1, 2014, the Philadelphia Daily News reported that 146 of the city's police officers had been fired - and 88 arrested - in a recent six year period for offenses that had included murder, rape, and extortion.[129]

On November 3, 2014, Officer Kevin Fant was caught on video masturbating on a subway train. On March 12, 2015, Fant was convicted of open lewdness and indecent exposure. He had been a transit cop for 12 years.[130][131]

2015

On January 6, 2015, ex-PPD officer Cheryl L. Stephens was sentenced to three years' probation for lying to a federal grand jury about a $100 loan while a cop in 2012. The prosecutor told the judge that Stephens helped make the government's case against a codefendant.[132]

On February 4, 2015, ex-PPD officers Jonathan Garcia and Sydemy Joanis received respective 17-year and five year prison sentences. The pair were convicted of the on-duty thefts of heroin and cash from a confidential informant. Garcia admitted to also falsifying documents.[133]

On February 6, 2015, ex-PPD officer Christopher Saravello pleaded guilty to federal conspiracy and extortion counts for extorting money and prescriptions drugs from drug dealers and buyers while an officer from November 2011 and June 2012.[134][135] A spokesman for the police department said Saravello was caught abusing prescription drugs, was suspended with intent to dismiss and resigned in 2012.[136]

On February 24, 2015, a report filed in federal court stated that PPD officers were continuing to illegally stop and search without having reasonable suspicion, contrary to a 2011 consent decree. During the first half of 2014, the report states that 37% of 2,519 pedestrian stops occurred without reasonable suspicion. The report stated that 39% of the 433 frisks conducted were made without reasonable suspicion. In the first quarter of 2014, police department figures indicated that while 39% of stops were without reasonable suspicion, only 5% of frisks were without reasonable suspicion.[137]

Police Commissioner Charles H. Ramsey requested a "Collaborative Reform" study from the U.S. Justice Department to improve relations with the public, making Philadelphia only the third city to receive such a study. On March 23, 2015, the report was released. The report recommended that the PPD change its training and policies on the use of deadly force by its officers. The report noted that "Incidents involving discourtesy, use of force, and allegations of bias by [PPD] officers leave segments of the community feeling disenfranchised and distrustful of the [PPD]...". The report said "...our assessment uncovered policy, training, and operational deficiencies in addition to an undercurrent of significant strife between the community and department."[138]
