Council of Ministers of Gujarat

Council of Ministers of Gujarat (Gujarati: ગુજરાતનું મંત્રીમંડળ)exercises the executive authority of State of Gujarat. It is chaired by Chief Minister of Gujarat. It is highest decision making body in state of gujarat. The council advices Governor of Gujarat in exercise of his functions. The entire council is collectively responsible to Gujarat Legislative Assembly.

Constitutional Provisions

Article 163 of Constitution of India provides to have a council of ministers headed by Chief Minister to aid and assist governor in exercise of his functions. All though, governor is executive head of the state, the actual executive powers are exercised by council of minister because governor is expected to work as per advice of council of ministers.

The Governor of Gujarat appoints Chief Minister of Gujarat. While other ministers are appointed on advice of chief minister by governor. A minister hold office during pleasure of governor. However, practically, a minister can be removed by governor only on advice of Chief Minister.

A Chief Minister of any other minister must be member of Gujarat Legislative Assembly. If he is not member of assembly, he shall obtain membership of assembly within six months of his appointment. Entire council is collectively responsible to legislative assembly and holds office till they enjoy confidence of Gujarat Legislative Assembly. They can be removed by passing No confidence motion in legislative assembly.

As per article 164 (1A) of Constitution of India, maximum strength of council of ministers in Gujarat will be 15% of total assembly strength . Hence, considering total strength of 182 members, maximum size of council of ministers can be 43 members.

Types of Ministers

Gujarat council of ministers follows westminster's model of cabinet. There are two type of ministers.

Cabinet Ministers

Actual power of decisions vests with cabinet ministers. The cabinet is chairmed by Chief Minister.

Ministers of State

They are also known as Deputy Ministers. They are appointed to assist cabinet ministers. However, maany times, they are given independent charge of their department. In that case, they enjoy same power like cabinet minister, in respect of decisons relating to their department. However, they do not participate in cabinet meeting.
