The parade had a great significance in demonstrating a Soviet resolve even at the most critical time in the war where the Soviet capital was under the direct danger. It was invoked many times later as such and was made a symbol. The painting demonstrates that and is used in the specific context of the article (see text.) The paint is of sufficiently low resolution to be useless for copying. It is widely spread on internet and in no way affects anyone's ability to make profit. Therefore, it is asserted that the usage of the picture in the WP article for the informational purposes by the non-profit WMF falls under both the FU exemption of the US copyright law as well as the narrower FU policies of the English Wikipedia

While the copyright of the painting belongs to the heirs of Konstantin Yuon, I, Alex Bakharev (talk), believe that using a low quality reproduction of the painting for the critical commentary of the style of its author constitutes fair use as define in the copyright law of the USA Alex Bakharev (talk) 23:25, 22 March 2008 (UTC)
