To the best of my knowledge David was not arrested under any "new" laws. but was charged with simple assault. Since he never did any thing to assault any body, just played a joke on them in full public view, he beat the charges. It is quite a stretch to label what he does as "performance." He hides behind some bushes and attempts to scare people. My first encounter with him was late at night walking along the waterfront with my date. He startled me so badly I practically struck him, thinking I was being mugged. He then had the temerity to ask me for money, claiming that since he managed to startle me, I owed him some money for his "Service." It is difficult to imaging how he could be called a "busker." I have seen the real buskers in London's Underground, and these people have actual talent with which they entertain passers-by. The "Bushman" simply relies on a cheap gimmick. How true.

I saw him in October 2006. He had a crowd of maybe 20-30. His "act" is a bit low rent, but it kept everyone laughing.
