This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. This picture of Will Cuppy is from a larger photo that also includes authors Marjorie Hillis (Roulston) and Constance Lindsay Skinner. It was taken at a Bobbs-Merrill reception to promote the release of "Orchids on Your Budget" by Ms. Hillis. It appeared in Publishers Weekly then owned by R.R. Bowker, in 1937. Permission was given in 1977 to use the full picture in a newspaper feature about Cuppy. Reed Business Information (RBI), the current owner of "Publishers Weekly," has no copyright information on photos from 1937, so it is likely that copyright on the picture has expired. Nonetheless, an RBI representative has told me that the 1977 permission is extended. There is also a strong possibility that the picture was created by Bobbs-Merrill and provided to Publishers Weekly for the purpose of promoting the Hillis book.
It should be added that the uploader has been unable to locate any undisputably free image of Will Cuppy. Family pictures of him that the uploader saw in the 1980s might still be in the possession of his sister's heirs, but to the best of the uploader's knowledge, they have not been released for free use.
