In general, the level of originality required by the courts for copyright protection has been falling. I don't yet know the current test applied by the Italian courts, but I'm looking into it. In any case, all photos (aprt from exceptions!) are protected by art. 87, while some (one might say many or most) are also protected by the provisions of Part One of the 1941 Law (as amended). The argument rests not merely on the interpretation of Italian courts, but also of those in the US, due to the restoration of copyrights in the Uruguay Round Agreements Act of 1994. A photo can be PD in Italy but protected in the US (and vice versa). Thnk-you for your constructive input on this question. Physchim62 (talk) 12:11, 12 September 2006 (UTC)
