[edit] Fair Use in Where Have All the Merrymakers Gone?

  1. The image adds significantly to the article because it shows the object discussed.
  2. The image is only used for informational purposes.
  3. It is a low resolution image, and thus not suitable for production of counterfeit goods.
  4. The image does not limit the copyright owners' rights to distribute the album in any way.
  5. The image is already used on various websites, so its use on Wikipedia does not make it significantly more accessible than it already is.
  6. It illustrates an educational article about the entity that the album represents.
  7. The image is used as the primary means of visual identification of the article topic.
  8. The cover is not used in such a way that a reader would be confused into believing that the article is written or authorized by the owner of the logo.
  9. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.

[edit] Source

  1. Derived from a digital capture (scan/photo) of the album/CD cover (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the record company or the artist. Claimed as fair use regardless.
