Wfm_emily_strange_fairuse_poster.jpg (350 × 236 pixels, file size: 21 KB, MIME type: image/jpeg)
An image of comic character Emily Strange and her four black cats.
This image obtained (and uploaded unmodified) from online retailer wickedcoolstuff, where it is a thumbnail image used for marketing a much larger poster.
Fair use is contended for the following reasons:
- only a small, low-resolution version is present
- no free alternative is available (as all extant representations of the character are copyrighted)
- it is not likely to (negatively) affect the value or sales of the original work (indeed, the creator's intention in generating this thumnail work was to enhance sales).
- it is not possible to reproduce by another means (as tha character is trademarked)
I have emailed the franchise owner to request permission, no response yet. -- Finlay McWalter | Talk 14:04, 19 May 2004 (UTC)
This image is of a drawing, painting, print, or other two-dimensional work of art, and the copyright for it is most likely owned by either the artist who produced the image, the person who commissioned the work, or the heirs thereof. It is believed that the use of low-resolution images of works of art
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content for more information. |
