I (Mark) believe that the use of this image on the article The West Australian constitutes fair use under United States law because:

  • it is of a very low web-resolution;
  • it adds significantly to the article in an educational context because it shows the masthead which has been used by the newspaper for a large proportion of its history;
  • it cannot be explained sufficiently with text alone, and hence is not mere decoration;
  • it is not readily replaceable with a free alternative because it is a trademark; and
  • it does not hinder the ability of the copyright holder (WA Newspapers) to profit from the "West Australian" franchise or the artwork portrayed in the logo.
