Fair Use: This image of Wayne Martin appears on an official Australian government website. It is almost impossible to get a photo of the judge outside of official photographs provided by the Government (this one) as you can't take photos in court. Politicians' photos (in the other branch of government) are available for publicity purposes under fair use - I think state Supreme Court judges at least would be available for fair use too under the same sort of provisions.
