This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.

Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

It's a low resolution copy of a promotional image.
It doesn't limit the copyright owner's rights to sell the promotion in any way, in fact, it may encourage sales.
Because of the low resolution, copies could not be used to make illegal copies of the newspaper.
The image is itself a subject of discussion in the article or used in the infobox thereof.
The image is significant because it was made by a famous artist.

Derived from a digital capture (scan/photo) of the promotional image (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the news company or the artist. Claimed as fair use regardless.
