Image of Mark V entering Harare court in November 2006. Clearly, the image cannot be reproduced. (1) The use of the image is to stimulate creativity for the enrichment of the general public. It is for a nonprofit, educational purpose. The article is on the subject of Rhodies and the subject of the image is a prominent Rhodie. (2) The image is of a factual and nonfictional nature and it has previously been widely published and circulated (3) The image used is small size and low resolution (4) This present use of the image has no impact on the image's marketability or sales value
