Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It is a significant photo of a John Cale as part of The Velvet Underground in the 1960s.
- It is of much lower resolution than the original (copies made from it will be of very inferior quality).
- The photo is only being used for informational purposes.
- Its inclusion in the article adds significantly to the article because John Cale's involvement in The Velvet Underground is discussed in the article.
- Because the image depicts a band that has since disbanded, there is almost certainly no free equivalent. As the image is from the 1960s, the people in it are now much older and a more recent image of them would not be representative of them in the 1960s and would fail its purpose of identification or commentary.
