Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

It is a historically significant photo of two military figures from opposing sides meeting after cessation of hostilities.
The photo is only being used for informational purposes.
The photograph features the military leaders of two opposing forces meeting after cessation of hostilities. Since the photo has been taken inside of a secure POW facility it is unlikely that other images may exist that feature this historic meeting.
