Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- The image is used as the primary means of visual identification of a significant aspect of the article topic, namely the superhero identity "Binary" of the fictional character more commonly called "Ms. Marvel."
- The image is from the cover of the comic book in which the character first adopted this identity, and so represents a historically significant use of the character.
- The use of the comic book cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the book.
- It is a low resolution image.
- The image is only a small portion of the commercial product.
- The character is copyrighted, and so it is impossible to replace it with an uncopyrighted or freely licensed image.
