This photograph is a derivative work of art based on a miniature created and copyrighted by Games Workshop. As such, it is used on Wikipedia under Fair Use guidelines only.
This is a two-dimensional representation of a copyrighted sculpture, statue or any other three-dimensional work of art. As such it is a derivative work of art, and per US Copyright Act of 1976, § 106(2) who owns copyright of the original has the exclusive right to authorize derivative works. Per § 107 it is believed that reproduction for criticism, comment, teaching and scholarship constitutes fair use and does not infringe copyright. It is believed that the use of a picture

The authors of the image (ThomaK WarheaD and Pak21) have released their rights to the photograph itself - meaning that the image enters the public domain the moment Games Workshop's copyright on the miniature design expires (a long way in the future as of 2006). As stated above, until that time the photograph may only be used under Fair Use guidelines.

This image, Ultramarines Dreadnought.jpg, is being linked here; though the picture is subject to copyright I (Pak21) feel it is covered by the U.S. fair use laws because:
- No equivalent free image can be created
- It adds significantly to the article by displaying a characteristic miniature of the vehicle being discussed
- The use of this image on Wikipedia will have no impact on the commercial value of the miniature or any other works the miniature is currently used in.
