It is believed that the use of this screenshot in the MOS Technology 8563 article qualifies as fair use under U.S. copyright law and Wikipedia policy, because:

  • The article contains specific discussion of the Ultra Hi-Res graphical utility, and this screenshot is useful and important in illustrating both the utility and the graphical functions of the 8563 display chip.
  • The screenshot encompasses only a small portion of one demonstration of the Ultra Hi-Res utility. It is, therefore, not a substitute for the utility itself.
  • The utility was published as a type-in program in February 1986 by RUN Magazine, which ceased publication in 1992. Furthermore, the Commodore 128 itself is generally considered an obsolete platform, and no C128 commercial software has been sold for many years. Therefore, the screenshot has no commercial value, and publishing it here does not impair the financial position of the program's copyright holder(s) in any way.
