This counts under fair use rationale as this is one of many images of a U2 Tour, so it doesn't limit selling of it, and a currently available image of this particular concert.

Given the small crowd allowed on the field during this Super Bowl, no clear free equivalents are available. The image depicts the scope of the 9/11 tragedy and how U2 integrated the event with their concerts, and how they played it to a national audience (this is a screenshot from the Super Bowl Halftime show, which means that many millions would've seen exactly this image on their television sets). This is a very low-resolution screenshot of the performance, and thus does not limit selling of the broadcast or count as retransmission.
