'Biography' Tracy K Barker is a former KBR employee who claims that she was sexually asaulted by a State Department employee ans Halliburton/KBR co worker in Basra, Iraq.[1][2][3] She has filed a lawsuit against the company and the employees.

She is the founder of the Tracy K Barker,' an advocacy agency for victims of sexual assault.

Tracy is a native of Ogden,Utah,the wife of Galen Barker she has always been a member of the United States Armed Forces since birth and currently stationed in Fort Bragg North Carolina. She started her contract of employment with Overseas Administrative Service Ltd. in Houston, Texas on July 24,2004.as administrative assistant.Tracy Barker was the first women to come forward after being Sexually Assaulted in 2005. Tracy is also the only known contractor who was a military wife at the time of the assaults. The first time Tracy Barker seeked help in Kuwait Tracy Barkers employer Halliburton/KBR placed Tracy in a Hard Car and drove Tracy to the desert of Iraq and dropped her off in the staging area alone where Tracy Barker had to find her way back and was able to get a ride with a food truck in a dangerous 19 hour journey of hell.

Tracy Barker married Master Seargent Galen Barker in November 2000. Master Seargent Galen Barker a member of the United States Army has served his country for the last 23 years. Galen and Tracy Barker are currently stationed with their family in Fort Bragg, North Carolina. Tracy Barker comes from a long line of family history in the Military and Government since Birth---

First Incident Complaint 2004 Tracy Barker began employment with Halliburton/KBR in July 2004 as administrative assistant. Tracy had reported to Halliburton that she was being abused at Camp Hope in Baghdad, also known as the Green Zone by her supervisor and that the Local National Iraqi Women were also being abused by her supervisor. After reporting this to Halliburton/KBR she claims that she was retaliated against by being locked up in a living container for 3 days having food brought to her like a prisoner and transferred to Basra in 2005.



Barkers Initial civil complaint 2005

Barker alleges she was sent to Basra Iraq in March of 2005. Upon her arrival Tracy cliams she was sexually harrassed by her immediate Supervisor and tormented. Tracy Barker was sexually assaulted by State Department employee Ali Mokhtare. Tracy Barker states she was lured to Mokhtares living quarters on a false work order and that after arriving to start the work order, Mokhtare told her of a horrific story of him and some employees raping a fillipino women in Saudi Arabia and how the Fillipino Women was found dead. Barker claims that she barely escaped Mokhtare raping her as he held her in a choke hold. When Barker reported this she was then locked up in a housing container again for 3 days not allowed any communication to the outside world and no medical treatment. Barker desperately called her husband Master Seargant Galen Barker at Fort Bragg, North Carolina. Master Seargant Barker claims he was trying to get to Kuwait in search for his wife to save her. When Tracy Barker tried to go to Kuwait for help Halliburton's hard car took Barker in the middle of the desert to a staging area in Iraq and left her in the desert where she was abandoned and had to find a ride back with a food truck 19 hours of hell and a dangerous journey.

Returning Back Home to The United States of America

After returning home Barker has received absolutely no justice from any avenues she has tried desperately to seek from anyone involved in her case. Tracy Barker received a call from State Department Lynn Falango stating that the State Department was covering up the assault and that she needed to get an attorney. Barker claims that Attorney Advisor for the State Department Henry Norcom tried to pay Barker $3,500.00 to drop the charges against Ali Mokhtare. Tracy Barker was a fighter and refused. Tracy received a call from an alleged gang raped victim which incident took place long after Tracy had been back in The US. When Tracy inquired how this victim got her contact information the alleged victim stated she received the information from EAP Employee Assistance Program Deborah Woodhams and asked for Tracy's help. Tracy's husband Master Seargant Galen Barker was able to track down Army Physician Jodi Schultz for the victim and introduced this victim to Tracy's Legal Council. Tracy has always helped anyone in need.

'Senator Hillary Clinton rejects plea for help'

Tracy Barker and her husband wrote letters to every Congressman and Senator in The United States. Senator Hillary Clinton refused to help Tracy Barker stating "she is not a New York Resident"!

State Department refuses prosection although signed confessions and affidative have been filed

Tracy Barker was ignored by the State Department refusing prosecution of Ali Mokhtare. Ali Mokhtare signed a confession that he had assaulted Barker. Wesley Lane Human resource Halliburton admitted to locking Barker up for 3 days in Camp Hope in 2004 and also admitted to watching Barker go to the bathroom stating "that Halliburton didn't want her to call the United States again for help". Barker also handed over a key witness who is Letty Surman Human Resource Supervisor to her Legal Council by asking for her statement back in 2005 by Attorney Cire and eventually receiving the information in 2007. Tracy was responsible for handing this witness attached to her affadvit to the counsel and The House Judiciary on December 19, 2007. The paperwork was not turned in on time for Tracy to testify at the hearing. So Tracy only could submit a written statement. Congressman Bob Ethridge expects Tracy to be able to testify soon and tell her full story that was not written in the statement that was handed into The House of Judiciary.

EEO Findings

Barker has worked with the Equal Employment Opportunity Commission who found violations in her favor. Barker was also informed that her case helped the other victims of assault by Halliburton. Barker is also working with State of Texas Workman's Compensation Attorney Gary Pitts. But the Assistant United States Attorney has still ignored Barker and her case.

Currently


"Abandoned" has been written by Barker and is looking for a publisher. Abandoned was written to bring the awareness of being sexually assaulted, abused and abandoned for over a year while working for one of our largest Army Contractors.

The United States Department of Justice (DOJ) has brought no criminal charges against the alleged assailants. Because of CPA Order 17, which limits the power of the Iraqi government to pursue legal action against foreigner contractors working in Iraq, it is possible that her assailants may not face any legal penalty for the alleged crime - at least by the Iraqi government itself.

However, Title 18, Part I, Chapter 1, § 7, of the United States Code, entitled "Special maritime and territorial jurisdiction of the United States defined," the United States has jurisdiction over the following:

"(7) Any place outside the jurisdiction of any nation with respect to an offense by or against a national of the United States."[21][22][23] Because CPA Order 17 provides limited immunity for U.S. Contractors from the Iraqi government, this offense may be outside Iraqi government's jurisdiction. Therefore, Title 18, Part I, Chapter 1, § 7, paragraph 7, of the United States Code, would apply because Jones is a national of the United States.[24]

Further, on December 19, 2007, during the testimony at the Congressional Hearing for Homeland Security. Tracy Barker was invited by Congressman Etheridge but when Tracy arrived she was not allowed to speak to the committe at all about her case. Instead Barkers documents were handed into congress by someone else. Tracy paid for her own travel even though her new born twins were fighting for their lives in NICU. Tracy believed if she could talk to the committee that it would prevent this to happen to other women. Further, the United States Department of Justice was subpoenaed to appear before Congress. The Department of Justice failed to appear. In response to the DOJ's failure to appear, Congressman John Conyers - chairman of the full House Judiciary Committee - said, "It is unacceptable for our own Department of Justice to refuse to testify today,"[30]

Congressman Poe does not ask for Justice in Barker's case even though Barker and other victims share the same investigator for the State Department,and Barkers case is 4 months old her documents are being used in other cases. Even worse Ms Slaughter demanded justice in another victims case and barely mentions Barker. This was brought to the attention of Congressman Poe and Slaughter and nothing has been done to this day.


The Department of Justice has refused to prosecute and turn over the name of the Attorney that refused to proscute. Congressman Bob Ethridge has helped Barker for many months and just recently put Barkers case on the Attorney Generals desk to be reopened and reviewed. The United States Department of Justice (DOJ) has brought no criminal charges because of CPA Order 17, which limits the power of the Iraqi government to pursue legal action against foreigner contractors working in Iraq, having justice has been impossible for Barker. The Federal Tort Claims Act also makes Justice impossible against State Department Employee Ali Mokhtare.

Therefore, Title 18, Part I, Chapter 1, § 7, paragraph 7, of the United States Code, would apply because Barker is a national of the United States.[16][17]---- Conclusion:

Although Tracy Barker has not received Justice and has not been able to tell her whole story, Tracy will continue to fight for her rights.
