hey. this piece is really a stub, and it's pretty crufty at that.
to start with I think we need to sort out, right at the top, the difference between intentional and unintentional torts, i.e., fraud versus negligence.
also a fairly novel but meaningful intentional tort that has arisen in recent years is a "battery" cause of action - harmful or potentially offensive touching.
we need to have a section on the difficulty with making toxic tort clams, in particular how difficult the burden of proof is, when a defendant can make a counter-claim that the whole environment is already contaminated, so their stuff wasn't so bad after all.
and we need some examples of famous toxic torts cases, such as Love Canal, several of the asbestos cases, agent orange and one or two of the big pcb cases. these can be summarized easily.
