[edit] Fair use for Don Imus
The image linked here is claimed to be used under fair use in the article Don Imus for the following reasons:
- The cover is being used in an original encyclopedic article on the life of Don Imus on Wikipedia, The Free Encyclopedia.
- It is a magazine cover, which serves a purpose to induce consumers to purchase the magazine. Interested consumers may purchase access to the magazine in question at TIME's website.
- it is of much lower resolution than the original (copies made from it will be of very inferior quality)
- It is not intended to lead a reader to believe that the encyclopedic article is endorsed by TIME, and the reader can visit TIME's website to obtain prints on the subject.
- It depicts the cover story that ensued regarding the Imus controversy.
This image is of a magazine cover, and the copyright for it is most likely owned by either the publisher of the magazine or the individual contributors who worked on the cover depicted. It is believed that the use of low-resolution images of magazine covers
on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. To the uploader: please add a detailed fair use rationale for each use as well as the source of the work and copyright information. |
