The image is used to display the setting and the style of gameplay in Thracia 776.
Does not detract from game as it is one screenshot displaying gameplay. Informative screenshot.
It does not limit Nintendo's ability to sell the game. It is obsolete and no longer commercially available from Nintendo anyway.
Thracia 776 was released for public purpose and thus was intended to be distributed to a wide audience.
