Think it's safe to say that this is in the public domain (Hutchinson died in 1780, assume that the artist painted the portrait in the year Hutchinson died (highly unlikely), and assume he lived for another 100 years (highly unlikely again), that's 1880 for the first year this portrait is in the public domain). --Bash 21:39, 7 October 2005 (UTC)
I think you are getting confused between copyright in works of art and copyright in reproductions of works of art. The copyright for this image rests with whomever took the photograph of the painting. They are more than likely still alive and/or the copyright is held by an archive or picture library. This looks like the painting held by the Massachusetts Historical Society, who would own the copyright to this image of it also.
