[edit] Fair use in Theocracy (album)

Though this image is subject to copyright, I feel its use is covered by the U.S. fair use laws because:

  1. It is a low resolution copy of a CD album cover.
  2. It does not limit the copyright owner's rights to sell the CD album in any way.
  3. Copies could not be used to make illegal copies of the album artwork on another CD.
  4. The image on the cover is significant because it was made by a famous artist, Theocracy (band).

[edit] Fair use in Christian metal

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. The image is only a small portion of the overall product and serves as an easily identifiable part of a larger entity.
  2. The copy of the image is low-resolution and will not produce high-quality copies of the art for illegal duplication. The quality is high enough to clearly present the image and to place the subject represented by the image in a good light.
  3. The use of the image will not affect the value of the original work or limit the copyright holder's rights or ability to gain commercially from the work.
  4. It illustrates educational articles about the subject represented by the image.
  5. The image is used as the primary means of visual identification of topics in the article.
  6. It adds significantly to the article because it illustrates the ground breaking album by one of the most significant bands in the genre being discussed in the relevant section of the article.
