This image is owned by KLF Communications and was used as a promotional shot of The KLF and inside the CD booklet of their album The White Room.
I (Kingboyk) assert that use of this image within The KLF article on Wikipedia is fair use under US law for the following reasons:
- It was commissioned by The KLF to promote them and their work;
- Use of the image in low resolution does not harm or prejudice the rights of the copyright owner;
- No free image which suitably illustrates Bill Drummond and Jimmy Cauty in their KLF persona as "Kingboy D" and "Rockman Rock" has been found and, given the band's very low number of public appearances is unlikely to be found;
- As a possible "Featured Article" The KLF article would suffer greatly if no image of the band were featured in the lead.
