Though the picture is subject to copyright I (Peter G Werner 04:17, 23 March 2007 (UTC)) feel it is covered by the U.S. fair use laws because:

  1. it is only a 30-second sample of a much longer track.
  2. it does not limit in any way the copyright owner's rights to produce a CD album from this track;
  3. the music sample is significant because it was made by a famous artist, The Screamers, being a notable representation of their sound, as well as an exmplar of the sound of the genre of early synthpunk.

This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:

  • It illustrates an educational article that specifically discusses the source band's role in the development of West Coast punk and of the synthpunk subgenre, as discussed in the accompanying text;
  • It is a low-bit-rate sample of about 30 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording;
  • It is not replaceable with a free-use sample of comparable educational value; and
  • It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
