While this picture is subject to copyright, its use within the article Source engine is believed to qualify as fair use under US copyright law for the following reasons:

  1. The image is used to illustrate a graphical capability of a game engine; this concept cannot easily be explained without the use of an image.
  2. It is taken from a promotional video that was made public by the copyright holder with the aim, in part, of advertising the capabilities of this engine.
  3. The image is not a significant portion of the work; it is a portion of a single frame, and is at a much lower resolution than would be typical for playing the game.
  4. Its use does not limit the copyright holder's ability to sell the work depicted.
  5. It cannot (as of October 2007) be replaced with a free image, because the games that currently employ the technology are all distributed under non-free licenses.
