[edit] Licensing
This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of web-resolution screenshots
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
[edit] Fair use
This image, TenebraeCap.jpg, is being linked in article Tenebrae (film); although the picture is subject to copyright I (Zzzzz 10:00, 18 April 2006 (UTC)) feel it is covered by the U.S. fair use laws because:
- According to Wikipedia:Fair use, "film and television screen shots are among the blanket categories of copyrighted images whose use on Wikipedia has been generally approved as likely being fair use when done in good faith." While I have already used the fair use copyright tag associated with film-screenshots, a recent peer review of the Tenebrae article suggested that further explanation might be necessary. The screenshot was copied directly from the Anchor Bay DVD release of Tenebrae. The image has been added to the article to assist in critical commentary/discussion of the film in question.
- This image illustrates the text next to which it appears, which describes the film's main themes and nightmare sequences.
- The shot visually illustrates actor/actress Eva Robin's, whose character is the catalyst for the protagonist´s actions throughout the film. The importance of the character is discussed in the text next to the illustration.
- It is of much lower resolution than the original (copies made from it will be of very inferior quality).
- It does not limit the copyright owner's rights to market or sell the work in any way.
- The image is being used in an informative way and should not detract from the original work.-Hal Raglan 23:09, 30 August 2007 (UTC)
