This image, Tenebrae.jpg, is being linked here; although the picture is subject to copyright I (Hal Raglan) feel it is covered by the U.S. fair use laws because:

  • According to the Wikipedia:Fair use tag for movie posters, "it is believed that the use of scaled-down, low-resolution images of movie posters, to illustrate the movie in question, qualifies as fair use under United States copyright law." While I have already used the fair use copyright tag associated with movie posters, a recent peer review of the Tenebrae article suggested that further explanation might be necessary. The movie poster is a scanned .jpg file taken directly from an insert included with the Anchor Bay DVD release of Tenebrae. The image has been added to the article to assist in critical commentary/discussion of the film in question.
  • The image is used as visual identification of the article topic.
  • It is a low resolution image.
  • The image is only a small portion of the commercial product.
  • It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
  • The use of the cover will not affect the value of the work itself or limit the copyright holder's rights or ability to distribute the original.

The use of the film poster is in good faith, and its inclusion enhances the quality of the article without reducing the commercial value of the motion picture in question.-Hal Raglan 22:49, 30 August 2007 (UTC)
