Though the picture is subject to copyright, it is covered by the U.S. fair use laws as it depicts visually, and for want of freely available images, the scale, magnitude, and effects, in visual terms, of the intervention of the Indian Air Force on the Pakistani war effort in 1971 and also qualifies the total destruction of the strike capability of the PAF no. 14 squadron during the war.

The image, although originally may be from a commercial source, is not ultimately sourced from such (see source URL). Given the archival character of the work, age and the historical context, it is not a cause of loss of revenue. Though the images are not in public domain, the Indian Information Act states that such images can be used to dissipate information.
