[edit] Summary

"Tart as a Double Entendre", the April 14, 2003 issue of the the webcomic Penny Arcade. The strip was removed from the site shortly after its initial publication,[1] due to a cease-and-desist letter by American Greetings Corporation over the use of company's characters "Strawberry Shortcake" and "Plum Puddin'". For verification, refer to this blog entry and this Slashdot discussion.

[edit] Fair use in Penny Arcade (webcomic)

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  • The image illustrates a parody of American McGee's Alice and Strawberry Shortcake that is discussed in the article.
  • No free equivalent of the image is available or could be created that would adequately give the same information.
  • The image has been previously published.
  • The image is not used in a manner that would likely replace its original market role as part of the Penny Arcade website, American McGee's work or Strawberry Shortcake products.
