[edit] Fair use rationale in Sweet Child

Although the picture is subject to copyright, I believe it is covered by the U.S. fair use laws because:

  1. a free alternative is not available;
  2. it is a low resolution copy of an LP album cover;
  3. it is only used in an article describing the album and including critical commentary;
  4. it is an iconic image by a well-known artist and is important to an encyclopaedic discussion of the Sweet Child album;
  5. it does not limit the copyright owner's rights to sell the album or image in any way;
  6. it's low resolution means that copies could not be used to make illegal copies of the album artwork;
  7. it's use is commensurate with usage throughout discographies and album listings across the world wide web.
