[edit] Fair use rationale in Sweet Child
Although the picture is subject to copyright, I believe it is covered by the U.S. fair use laws because:
- a free alternative is not available;
- it is a low resolution copy of an LP album cover;
- it is only used in an article describing the album and including critical commentary;
- it is an iconic image by a well-known artist and is important to an encyclopaedic discussion of the Sweet Child album;
- it does not limit the copyright owner's rights to sell the album or image in any way;
- it's low resolution means that copies could not be used to make illegal copies of the album artwork;
- it's use is commensurate with usage throughout discographies and album listings across the world wide web.
[edit] Licensing
This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
