Supreme Court of Prince Edward Island

The Supreme Court of Prince Edward Island is the top court in the Canadian province of Prince Edward Island and the highest Court of Appeals in the province.

The Supreme Court has two divisions : the Trial Division and the Appeal Division, and consists of eight justices, with one acting as Chief Justice, as well as one supernumerary justice.

[edit] Trial Division

The Trial Division of the P.E.I. Supreme Court sits in Georgetown, Summerside, and Charlottetown, and consists of five justices.

The Trial Division deals with pre-trial matters and hears trials dealing with such cases as family matters, estate and probate, as well as indictable criminal matters, which can be heard with or without a jury. The Trial Division also hears applications for judicial reviews concerning the decisions of tribunals with the Provincial Court of Prince Edward Island. Appeals from the decisions of the Trial Division are heard by the Appeal Division.

The Appeal Division hears appeals from the Provincial Court on indictable criminal matters as well as appeals from decisions made at the Trial Division. Appeals from the decisions of the Appeal Division can be heard at the Supreme Court of Canada.

The Appeal Division sits only in Charlottetown.
