This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. This image is a promotional picture of The Someloves. Its inclusion here is claimed as fair use because:
- It illustrates educational articles about the band of whom the illustration was taken.
- The image is used as the primary means of visual identification of the article topic.
- It is a low resolution image.
- The image is only a small portion of the commercial product.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value. As the image is of the band in the mid 1980's with the original line up. As the band have only played a limited number of performances since they disbanded in 1990 no free images currently exist.
- The use of the image will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original.
The use of the image is in good faith, and its inclusion enhances the quality of the article.
