There is another case with the same name namely, Smith v Hughes [1960] 1 WLR 830 where it was an offense under s.1 of the Street Offences Act 1959 for a prostitute to "solicit in the streets... for the purpose of prostitution". The facts of the case was that prostitutes were soliciting in houses next to the street. This section of the Act can be read two ways, if taking the literal rule, then the defendent could not be guilty. However, if we apply the mischief rule, and taking into account what the mischief the Act was remedying, then the outcome would have been guilty. The High Court upheld the latter contention.
