Though this image is subject to copyright, I, User:Sue Wallace, believe its use is covered by the U.S. fair use laws for the article mentioned above because:

  1. Used in infobox for the band
  2. Low resolution
  3. Is only as much resolution as necessary to identify and show the original band members while the band was active for critical and historical analysis, not enough to be used for illegal purposes such as piracy.
  4. Image is derived from a scan by http://static.rateyourmusic.com/album_images/11914.jpg (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the record company or the artist. Claimed as fair use regardless.
  5. Entire front cover is used.
  6. The image illustrates and confirms the visual appearance of a historically notable band Small Faces in an article whose subject and title is the same. The article provides indepth, factually cited information on the history of the Small Faces and their musical works throughout their career (1965-1969). I believe the historical image is therefore needed in order to complete the critical analysis and to increase the readers understanding and knowledge of the subject which is being discussed.
  7. No copyright free image of the band has been found and any derivative would still be subject to copyright.
  8. Small Faces disbanded in early 1969 (nearly 40 years ago) and there are still no copyright free images that have been released. Also two of the band members are now dead so no new free band images can be created.
  9. This image and others like it are already widely distributed to identify the band as part of music reviews and biographical catalogs and reviews, so I believe I degrade no market value by providing it here.
