As such it is a derivative work of art, and per US Copyright Act of 1976, § 106(2) who owns copyright of the original has the exclusive right to authorize derivative works. Per § 107 it is believed that reproduction for criticism, comment, teaching and scholarship constitutes fair use and does not infringe copyright. It is believed that the use of a picture

i found this photo at http://www.artinfo.com/articles/story/11876 on the website of artinfo.com, illustrating an article about jonathan meese.
however, the photo was taken by and is owned by jan bauer. the same photo appears in an artists book that i have about meese (Mama Johnny. Köln: Contemporary Fine Arts and Walther König, 2007) and is credited to bauer in this book, which was published by CFA, meese's gallery.
the use of this photo to illustrate an article about meese and his work qulaifies as free use. it does not just illustrate what meese looks like, but it shows him in the act of performing, with props he typically uses. at the same time it illustrates him and his work. i cannot replace this with another photo obtained another way and achieve the same results.
