- Purpose and character of the use is for educational purposes, not to sell Shocker markers
- The photo is copyrighted
- The entire photo is being used, albeit at a low resolution
- Effect on the market for the image is low; it is unlikely that the use of this photo in the article will prevent people from going to the Smart Parts website to view more photos of it. Furthermore, Smart Parts does not profit from the sale of photos of the marker; it profits from sales of the marker itself. Providing photos of the marker will more likely than not promote further sales of the marker.
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership.
