- User:Chick Bowen asserts that this image is fair use in the article Sheldon Dick for the following reasons:
- It is a low-resolution version of a badly damaged photograph which would not provide profit and thus will not effect the copyright holder's use of it.
- It is necessary illustration for the article as the only available image of the subject.
- It is almost certainly not replaceable by a free image. The subject died in 1950, and since the LOC has no record of a photograph of Dick in the FSA-OMI collections, it is highly unlikely that any photograph of Dick by a federal employee exists, and no other image of Dick as an adult, most likely, could be demonstrated to be public domain.
- The LOC notes at this webpage that all of the photographs linked to from that page (including this one) have "no known restrictions." This would indicate that no copyright claim has been made. In fact, the image may well be in the public domain in any case. It was in the collection of the New York World-Telegram, which was donated to the LOC. If the World-Telegram owned the copyright (a possibility that seems likely since the eyes have been airbrushed—visible clearly on the high-resolution version at the LOC page linked above—which was commonly done to increase contrast for newspaper use), it is now in the public domain. It could be under copyright if the photographer sold only the print and reproduction rights to the newspaper, but such a claim would likely be unenforceable because of the rights issue. It should thus, most likely, be considered either public domain or "copyrighted free use," but I am making a fair use claim here to be certain.
