This image (logo) falls into the public domain, as it signifies the emblem of a publicly traded company. Sepracor is therefore obliged by U.S. copyright law to release any rights that it may claim for its logo on its website. For further information regarding this topic, please refer to Kelly v. Arriba Soft Corporation (2003), which marked the first Supreme Court case involving copyright infringement of logos on the internet.
Sepracor is also a publicly traded company, and therefore, whatever rights it may reserve for its logo and insignia are considered fair use.
