[edit] Fair use in The Second Element
This image is being used to illustrate the article The Second Element. I feel that this qualifies as fair use because:
- 1. It is a web-resolution image.
- 2. It does not limit the copyright owner's rights to sell the CD in any way.
- 3. The image is significant because it depicts the cover of the single that is the subject of the article.
- 4. No free or public domain images could replace this one, as all of the promotional artwork for this single and the album it comes from is copyrighted, and anything else would be inadequate for identification or commentary.
[edit] Licensing
This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
