Other information

Although the picture is originally copyright, it is covered by fair use because:

  1. It is a low resolution copy of a comic book cover, hence, only a small portion of the commercial product;
  2. The use of the image will not affect the value of the original work or limit the copyright holder's rights or ability to sell or distribute the original comic book;
  3. Copies of this image could not be used to make illegal copies of the comic book;
  4. The image is used as the primary means of visual identification of topics in the article. For a visual medium such as comic books, words alone cannot adequately describe the subject;

[edit] Fair use rationale

This image, Rogue.jpg, is being linked here; though the picture is subject to copyright I (RossF18 16:59, 27 July 2007 (UTC)) feel it is covered by the U.S. fair use laws because:

  1. No free alternative can exist given the likeness of the character is a trademark and thus protected (Wikipedia:Non-free use met);
  2. It is a low resolution copy of a comic book cover;
  3. The image was released to the media to promote the issue in question (Respect for commercial opportunities. Non-free content is not used in a manner that is likely to replace the original market role of the original copyrighted media Wikipedia:Non-free use met);
    1. (a) Minimal usage.
    2. (b) Minimal extent of use.
  4. It does not limit the copyright owner's rights to sell the comic book in any way;
  5. Copies could not be used to make illegal copies of the comic book cover art on another comic book;
  6. The comic is significant for the character (as it is one of only few she appeared in), provides a great illustration of the character for the article, and provides a visual animosity between Kimura and X-23 (which is key apsect of her personality in the article). Non-free content is used only if its presence would significantly increase readers' understanding of the topic, and its omission would be detrimental to that understanding.(Wikipedia:Non-free use met);
  7. Content. Non-free content meets general Wikipedia content requirements and is encyclopedic.
  8. Previous publication. Non-free content must have been published outside Wikipedia (Wikipedia:Non-free use met).
  9. Media-specific policy. The material meets Wikipedia's media-specific policy. For example, images must meet Wikipedia:Image use policy. (Wikipedia:Non-free use met);
  10. One-article minimum. Non-free content is used in at least one article. (Wikipedia:Non-free use met);
  11. Restrictions on location. Non-free content is allowed only in articles (not disambiguation pages), and only in article namespace, subject to exemptions. (To prevent an image category from displaying thumbnails, add to it; images are linked, not inlined, from talk pages when they are a topic of discussion.) (Wikipedia:Non-free use met);
  12. Image description page. The image or media description page contains the following: (a) Attribution of the source of the material and, if different from the source, of the copyright (Wikipedia:Non-free use met (see below)
