[edit] Summary
Not sure if there's a precise category which covers this image. It's a publicity still for a radio show, specially taken to promote the show. Its intended use on wikipedia is to illustrate the radio programme for which the picture was taken. Indeed, the filename given here is precisely the same one the authors (BBC Radio 4) assigned to it, further indicating the fact that it was taken for promotional purposes. Given that the radio show in question has never been released on CD or audio cassette, there really is no other image out there to currently use for illustrative purposes. Feel free to take down if you think it violates policy. CzechOut ☎ | ✍
- Licensing template has been changed for accuracy; fair use rationale added. Suggest this image may no longer be the most appropriate image to illustrate the radio programme, when and if the show is ever released to CD or some other off-air format that compels the creation of a logo. [edit] Licensing
This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion as established by these terms of use. It is believed that the use of some images of promotional material to illustrate:
qualifies as fair use under United States copyright law. Any other usage of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Publicity photos. Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license. Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights. |
[edit] Fair Use for Rigormortis.jpg
Non-free / fair use media rationale for Rigor Mortis (radio) | |
---|---|
Description |
An image showing the character of Dr. Anthony Webster. As Rigor Mortis was a radio program, the only possibility of any images are promotional ones like this one supplied by the owners, the BBC. |
Source | |
Article | |
Portion used |
This is the entirety of what was already a low-resolution, small-sized web image. |
Low resolution? |
This image is unaltered from its original. Since the image never existed within the confines of the work it advertised, it's unclear that alteration is necessary to protect the interests of the owner. The image has no contextual meaning of its own. |
Purpose of use |
Illustration of one of the characters of the radio programme, contemporary with his performance of the role. The article clearly identifies the image as being a BBC promotional photograph. |
Replaceable? |
There are no other known photographs which could replace the image. This is, so far as is known, the only image which illustrates the character of Dr. Anthony Webster — and the programme Rigor Mortis — to date. At some future date, an image of the CD cover may be a more appropriate choice, but the work has so far never had an off-air release. Even a logo for the programme has yet to be created. Even in that eventuality, however, it should be noted that this image is unrepeatable in that it will not be possible to capture an image of Peter Davison playing this role at the age seen in this contemporary photo. |
