This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. This image, Riddleinhogwarts.JPG, is being linked here; though the picture is subject to copyright I feel it is covered by the U.S. fair use laws because:

1. No free alternative can exist given the likeness of Voldemort is a trademark and thus protected;
2. It is a low resolution copy of a movie poster;
3. The image was released to the media to promote the movie in querstion, Harry Potter 2;
4. It does not limit the copyright owner's rights to sell the movie or the book in any way;
5. Copies could not be used to make illegal copies of it, because it is too low-resolution;
6. As JK Rowling refrains from depicting Voldemort / Tom Riddle in her books, no original pix of both are possible, but a picture of his movie version would greatly enhance the article
7. no free alternatives seem to exist
