It is believed the use of this image in the article, The Last Waltz, is fair use because:

  1. The image is a screenshot from the DVD release of the film The Last Waltz originally created by MGM/United Artists, and intended for wide distribution.
  2. The screenshot is of much lower resolution than the original film (copies made from it will be of inferior quality).
  3. There are no free or public domain images of this film. The image is not replaceable.
  4. Furthermore, the subject in the photo is dead, and there is no way to obtain a free image of him, and for that reason as well, this image is not replaceable.
  5. The screenshot does not limit the copyright owners' rights to distribute the film in any way.
  6. The screenshot is being used for informational purposes only, and its use is not believed to detract from the original film in any way.

In addition to reasons given above, it is believed that this image also qualifies for fair use in the article about Rick Danko because:

  1. The subject depicted in the image is dead and it is not possible to obtain a free image of him. The image is not replaceable.
  2. While the image is being used as a primary means of identification of the subject, the article it accompanies also describes his work in The Last Waltz.
