Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

The image is used to identify a notable character in the Death Note series.
It is a low resolution image, and cannot be used for production of counterfeit goods.
It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.

This fair use justification has been used to justify the image's use in Death Note and List of Characters in Death Note as well, although the image is not currently used in those articles.
