This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
[edit] Fair use in Seattle Pro Musica
Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
This is the cover of an audio recording (compact disc) published by Seattle Pro Musica. It was obtained from the publisher's web site ( [1]). Only the front cover is shown. Neither the back cover nor the interior program notes have been reproduced, so this use does not substantially compete with the publisher's use of the work. The resolution has not been reduced from the original. The image is used to visually identify an audio recording which is the subject of the article. The image cannot be replaced by a free content image. The image has been uploaded with the knowledge and consent of the publisher, which has agreed that use of the image in connection with commentary or criticism of the work constitutes fair use.
[edit] Source
- Derived from a digital capture (scan/photo) of the album/CD cover (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the record company or the artist. Claimed as fair use regardless.
