In the examples of acceptable use, you should say in which article the use is acceptable. It's inaccurate to say "image X is O.K. in regard to criteria 2". We need to say "the use of image X in article Y is O.K. in regard to criteria 2". Images Image:JFKmotorcade.jpg and Image:Kent_State_massacre.jpg, that you cited as good examples, are surely overused. --Abu badali (talk) 17:21, 13 July 2007 (UTC)

But the images are non-replaceable no matter where they are used. Context is important for NFCC#3 and #8, but for criteria #4 or #10, for example, it passes or fails based on the image itself, not based on how it's used. I would say that replaceability, strictly, is a characteristic of the image and not how it's used. It interacts with NFCC #8, certainly, and that interaction is determined by how it's used. "But the images are non-replaceable no matter where they are used" - I completely disagree. Replaceability is completely about context. Image:JFKmotorcade.jpg, for instance, is replaceable if used to illustrate Motorcade. --Abu badali (talk) 19:44, 13 July 2007 (UTC)

I think the examples of acceptable use in criterion 8 need to fleshed out a bit more. Perhaps the O.J. Simpson magazine covers, or the magazine cover vs. movie poster in Steinberg v. Columbia Pictures Industries, Inc. -- in other words, articles where if the non-free image were omitted, it would be detrimental to the reader's health -- err, understanding. :) howcheng {chat} 20:52, 13 July 2007 (UTC)
