[edit] Fair use for List of X-Files episodes and The X-Files

Though the picture is subject to copyright I (Emrbyonix) feel it is covered by the US fair use laws because:

it is a low resolution still of a television episode;
it does not limit the copyright owners rights to sell the episode in any way, it may in fact help promote sales of the episode;
it illustrates the episode in question and aids commentary on the importance of the episode for the relationship between the characters depicted.
this image was chosen because Mulder and Scully appear in the shot, which is integral to the point being illustrated (but their faces are not visible, cutting the commercial infringement possibilities of the shot)
The copyright is most likely held by Fox Broadcasting Company.
