The uploader claims that this is a self-made image. However, it looks like a publicity picture (not home made) and I have found some sites that posted this picture back in 2005 (which would make sense for a publicity picture since that is when Mario Kart DS came out) [1], a Mario Wiki where the picture was uploaded over a year ago [2] and another site that had the pic up in 2005 [3]. I think this prooves that the user did not create the pic (plus it doesn't have any source or license tags). — TJ Spyke 00:32, 7 March 2008 (UTC)

CC-BY-SA-3.0 lisence is incorrect according to the source. Images are licensed non-commercially and no derivatives(CC-BY-SA-NC-ND). That is not apropriate for wikipedia. There is also a more free license for web publishing, but that is to limited to be conidered a free license. I can not see that fair use can apply. Rettetast (talk) 15:19, 7 March 2008 (UTC)

ANYONE, by which we mean commercial and non-commercial alike, can use FreeFoto.com images in an online setting, providing they provide attribution to the image and a link back to FreeFoto.com (either the image or the main site). This license allows blogs, social networking sites and use in emails, just to name a few, providing they provide the required attribution, this includes sites that pay people to write, carry advertising or are selling and promoting products. The only requirement the attribution and link back.

I would look more at their Commercial Use License Agreement, specifcally:

User Warranties. You warrant that you will take all necessary steps to prohibit and prevent duplication or further distribution of the image(s).

We certainly don't do that, we basically encourage people to re use the content. Additionally, its unclear whether they allow derivative works (so we could take those ugly watermarks out). Mr.Z-man 18:38, 7 March 2008 (UTC)

Freefoto.com act as a stock photography supplier, and a web hoster. The Commercial Use License Agreement Z man refers to there applies to the commercial sale of their photos to customers, not the low resolution ones hosted on the website. MickMacNee (talk) 19:32, 7 March 2008 (UTC)

This is my own work. I spent two weeks at training camp last year taking pictures as sports photography is a hobby of mine. I am not sure how to respond to the reasoning that since I have not written any articles or made any other contributions, my authorship is in question. I made the photograph low-resolution on purpose and didn't include any meta data because I thought it was unneeded. I tried to follow all the guidelines for posting pictures yet apparently I missed something. Please let me know what proof your require to verify my authorship and what guidelines I need to follow should I choose to upload any more images. Bearhanded (talk) 01:23, 10 March 2008 (UTC)

If it is yours, then it is a violation of Wikipedia policy to include a watermark on the image of user-created content. You should reupload the image (under the same name) with the watermark removed. I would be satisfied if you either upload the same image with the watermark removed (meaning you would have to have the original) or upload or point to a larger resolution image with metadata here or somewhere on the internet.
